Terms of service

The agreement behind a BuiltByAri project: what we deliver, what it costs, what we need from you, and what happens if either of us walks away.

Last updated 2 November 2026.

The short version

One fixed price, quoted in writing. Two rounds of revisions. You own the site once it is paid for. Cancel with 30 days’ notice and take your files with you.

Full agreement below. If anything is unclear, ask before the project starts — we would rather explain it than argue about it later.

1. Agreement

These terms apply to services provided by BuiltByAri (“we”, “us”) to the client named on a written quote or proposal (“you”). Where a signed quote or project proposal conflicts with these terms, the signed document wins. Beginning a project, or paying an invoice, means you accept these terms.

2. Services

We provide website design, front-end development, and ongoing care:

  • Design and build of a custom website, as described in the written scope.
  • Hosting, domain management, SSL, backups, and search listing setup.
  • Content updates and support as included in your plan.

We do not provide legal, accounting, or marketing advice, and we do not guarantee search rankings or sales results. Search visibility depends on factors outside our control, including competition, reviews, and Google’s own changes.

3. Quotes, scope, and changes

Every project starts with a written scope listing the pages, features, timeline, and fixed price. Anything not listed is out of scope. Additional pages, features, integrations, or extra revision rounds are quoted in writing before we begin them, and you are never billed for work you have not approved.

4. Fees and payment

  • Plans are $50 CAD per month or $500 CAD per year, payable in advance.
  • Invoices are due within 14 days. Prices are in Canadian dollars.
  • Work beyond the included updates is quoted in advance and invoiced on completion.
  • We may change plan prices with 30 days’ written notice; the change applies from your next renewal, never retroactively.
  • Overdue invoices may pause hosting and updates until the balance is settled.

5. Your responsibilities

  • Provide accurate business information, content, logos, and photographs, and confirm you have the right to use them.
  • Respond to review requests within five business days.
  • Give us the access we need (domain, hosting, Google Business Profile) or ask us to set these up on your behalf.
  • Keep your side of the timeline: delays in content or approvals move the launch date by the same amount.

6. Revisions and approvals

Two rounds of design revisions are included before build, and one round of refinements after the site is assembled. Each round is a single consolidated set of feedback. Approving a design authorises us to build it; changes requested after approval are treated as new scope.

7. Timelines

A standard five-page site typically takes two to three weeks from the kickoff call. Timelines are estimates made in good faith, not guarantees. We will tell you as soon as we know a date is at risk, and we are not responsible for delays caused by third-party providers, outages, or events outside our control.

8. Ownership and licence

Once your invoices are paid, you own the design, content, and custom code created for your project, and the domain registered in your name. We retain the right to reuse general techniques, components, and know-how, and to display the finished site in our portfolio unless you ask us in writing not to.

Third-party assets — typefaces, icons, stock photography, or open-source libraries — remain under their own licences, which we identify in the handover document. During the project, you license us to use your content for the purpose of building and promoting your site.

9. Hosting, domains, and renewals

Hosting, SSL, backups, and domain renewal are included while your plan is active. Domains are registered in your name. If you cancel, the domain is transferred to you or your new provider, and we hand over the site files. We are not responsible for downtime caused by third-party hosts, registrars, or certificate authorities, though we will help resolve it.

10. Updates and support

Monthly plans include two content updates per month; yearly plans include three and priority replies within one business day. An update means a change to existing content: text, images, hours, prices, menu items. New pages, new features, and integrations are quoted separately. Unused updates do not roll over.

11. Cancellation

Either party may cancel with 30 days’ written notice. Your site stays online until the end of the period you have paid for, after which hosting and updates stop. Fees already paid for time used are not refunded. There is no cancellation fee, and no penalty for taking your files elsewhere.

12. Acceptable use

We will not build or host sites that promote hate, harassment, illegal goods or services, or content that infringes someone else’s rights. If a site we host is used in a way that creates legal risk or breaks a provider’s terms, we may suspend it after telling you, and will work with you on a fix.

13. Confidentiality

We keep your business information, access credentials, and unreleased plans confidential, and use them only to deliver the project. We ask the same of you with respect to our process documents and code before launch.

14. Warranty and liability

We provide services with reasonable skill and care, and will fix defects in our own work at no charge for 30 days after launch. Beyond that, the site is provided “as is”.

To the extent permitted by law, our total liability arising from a project is limited to the fees you paid us in the twelve months before the claim, and we are not liable for lost profits, lost revenue, or indirect or consequential losses. Nothing in these terms limits rights that cannot be limited under Ontario consumer protection law.

15. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes will be heard by the courts of Ontario, sitting in Toronto.

16. Changes to these terms

We may update these terms; the version in force when you start a project, or when your plan renews, is the one that applies to that period. The current version always lives at web.asteinberg.me/terms.
